1Introduction

Welcome to EmailGuard. By accessing or using our email validation services, website, and resources,

you agree to comply with and be bound by these Terms of Service. Please read these terms carefully

before using our services. If you do not agree with any part of these terms, you may not use our services.

2Definitions

- "Service" refers to the email validation services, API, and related tools provided by EmailGuard.

- "User," "you," and "your" refer to the individual or entity accessing or using our Service.

- "EmailGuard," "we," "us," and "our" refer to the company providing the Service.

- "Account" refers to the registered user account created to access and use our Service.

- "API" refers to our Application Programming Interface used to interact with our Service.

3Account Registration and Security

To access certain features of our Service, you must create an account. When registering, you agree to provide accurate,

current, and complete information. You are responsible for maintaining the confidentiality of your account credentials

and are fully responsible for all activities occurring under your account. You must immediately notify us of any

unauthorized use of your account. We reserve the right to terminate accounts, remove content, or cancel orders at our discretion.

4Service Usage and Restrictions

Our Service is designed to validate email addresses for legitimate business purposes. You agree not to:

- Use our Service for any illegal purpose or in violation of any laws

- Attempt to probe, scan, or test the vulnerability of our systems

- Interfere with or disrupt the integrity or performance of the Service

- Attempt to gain unauthorized access to the Service or its related systems

- Use our Service to send unsolicited emails (spam)

- Resell, redistribute, or repackage our Service without explicit written permission

- Exceed your plan's rate limits or quotas

We reserve the right to monitor usage patterns and take appropriate action against abusive behavior.

5API Usage

- Respect rate limits and quotas associated with your subscription plan

- Implement reasonable caching to minimize unnecessary API calls

- Not attempt to reverse engineer our API or validation algorithms

6Payment Terms

Subscription fees are billed in advance and are non-refundable. By subscribing to our Service, you authorize us to

charge your payment method for the subscription plan you selected, plus any applicable taxes. Prices for our Service

may change, and we will provide notice of any price changes in advance. If we are unable to process your payment,

we may suspend or terminate your access to the Service.

7Data Privacy and Security

We take data privacy seriously. Our collection and use of personal information is governed by our Privacy Policy,

which is incorporated into these Terms by reference. By using our Service, you consent to the collection, processing,

and storage of your information as described in our Privacy Policy.

We implement reasonable security measures to protect your data, but no method of transmission or storage is 100% secure.

You acknowledge this limitation and use our Service at your own risk.

8Intellectual Property Rights

and images, are owned by EmailGuard and are protected by copyright, trademark, and other intellectual property laws.

Our Service may contain third-party content that is subject to their own terms and conditions.

You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.

9Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Service will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected.

We make no guarantees regarding the accuracy of email validation results, as email systems can change and validation

techniques have inherent limitations.

10Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EMAILGUARD BE LIABLE FOR ANY INDIRECT, INCIDENTAL,

SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL,

ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE

DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11Indemnification

You agree to indemnify, defend, and hold harmless EmailGuard and its affiliates, officers, directors, employees, and agents

from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees,

arising out of or in any way connected with your access to or use of the Service, your violation of these Terms,

or your infringement of any intellectual property or other rights of any person or entity.

12Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason,

including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to

ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or

by posting a notice on our website. Your continued use of the Service after such modifications constitutes your acceptance

of the revised Terms. It is your responsibility to review these Terms periodically.

14Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard

to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved in the courts

of San Francisco County, California, and you consent to the exclusive jurisdiction of such courts.

15Miscellaneous

These Terms constitute the entire agreement between you and EmailGuard regarding our Service and supersede any prior

agreements. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force

and effect. These Terms do not create any agency, partnership, joint venture, or employment relationship.

You may not assign or transfer these Terms without our prior written consent, but we may assign or transfer these Terms

without restriction.
